Cardholder Terms & Conditions

This document lays out the Terms and Conditions which are applicable to Cards issued by YES BANK and YOLO ON-LINE OPC Private Limited

  1. Definitions :
    • In this document the following words and phrases shall have the meanings as set below unless the context indicates otherwise:
    • “YOLO” shall mean YOLO ON-LINE OPC Private Limited having its registered office at G-701, Ambience Island Lagoon, NH-8, Gurgaon 122001 and its successors and permitted assigns.
    • “YES BANK” shall mean YES BANK Ltd., a banking company within the meaning of section 5 (c) of the banking Regulation Act, 1949 incorporated under the Companies Act 1956, having its registered office at Nehru Centre, 9th Floor, Discovery of India, Dr A B Road, Worli, Mumbai 400 018.
    • “Corporate” shall mean an Organization which has signed an Agreement with YOLO
    • "Card" shall mean a virtual or physical prepaid card jointly issued by YES BANK and YOLO ON-LINE OPC Private Limited
    • “Cardholder” means a person to whom a card is issued and who is authorized to hold and use the card. It also refers to any person who is ten years of age who has downloaded the application and registered with YOLO and YES BANK for availing services offered through the application
    • “Application” refers to the YOLO mobile application which can be downloaded from iOS App Store and Google Play store for Android mobile operating systems to avail products and services offered by YOLO and YES BANK through this mobile application.
    • “ Wallet” refers to an open system payment instrument which can be used for purchase of goods and services, including financial services like funds transfer at any card accepting merchant locations (point of sale terminals) and also permit cash withdrawal at ATMs / BCs with transaction limits
    • “Registered E-mail Id” shall mean the e-mail Id through which a Cardholder has registered on the Application to access products and services offered by YOLO and YES BANK
    • ‘’Personal Information’’ refers to the personal information provided by the Cardholder to YOLO and YES BANK
    • “Services” refers to the products and services as made available by YOLO and YES BANK to Cardholders through the Application from time to time and as more specifically mentioned in clause, further in this document.
    • "Website" refers to the website owned, established and maintained by YOLO located at the URL www.yolo.cards
  2. Annual Fees and Charges excluding Government Taxes, as applicable from time to time

    • Card Replacement fee- Rs.150/-

    • In case of Cash Withdrawal from ATM’s the applicable charges will be debited to the Card.
    • Loading the card via Debit Card, Credit Card or Net Banking, UPI, IMPS will attract fees as charged by the Payment Gateway
    • Loading the card via Cash will attract fees as charged by Cash Load points for rendering this service
    • Know Your Customer (KYC) checks will attract fees as charged by Yes Bank’s Business Correspondents/Yes Bank’s Authorized YOLO offices/Affiliates for rendering this service
    • The above charges are exclusive of all taxes. All taxes as applicable will be levied. Charges and fees mentioned above are subject to review/changes from time to time at the sole discretion of YOLO and YES BANK. For latest charges, please visit our website www.yolo.cards
  3. Withdrawal and Top-up limits
    • Subject to availability of balance on the Card and subject to KYC and any other prior checks (if and as applicable from time to time) ATM Cash withdrawal on the physical card is restricted to a maximum of Rs. 50,000 at any given point of time, or as prevailing from time to time, on the basis of regulations in place and is subject to daily withdrawal restrictions placed by the bank whose ATM is being used. Use of the Card post KYC is subject to a maximum top-up of Rs. 50,000 at any given point of time, or as prevailing from time to time on the basis of regulations in place. Use of the Card, without KYC is subject to a maximum top-up of Rs. 20,000 per month, or as prevailing from time to time on the basis of regulations in place
  4. Withdrawal and Top-up limits
    • You can view your transaction details by accessing your account on the YOLO application online using your mobile or your computer.
    • The Cardholder must immediately raise any disputes pertaining to transactions to YOLO’s Customer Care by sending an email to YOLO on yoloassist@yolo.cards
    • Grievance Redressal Escalation: We have a Grievance Redressal Centre within the organization. If you want to make a complaint, please write to grievances@yolo.cards or call our Customer Care on 9017-950-960 or write to yoloassist@yolo.cards . Our executives will help you with any queries you may have. Any letter or other communication can be sent to the below address:

  5. Cancellation/Withdrawal of the Card :
    • The Card shall remain the property of YES BANK at all times. If the Card Holder decides to cancel the Card, he/she/it will suspend the card on the YOLO Cards application and acknowledges that he/she/it will not be able to use the card for any transaction after disabling the card. The Card Holder shall also pay dues, if any, payable to YOLO and YES BANK in connection with the Card. If YOLO and YES BANK decide to cancel/withdraw the Card, YOLO and YES BANK shall give a prior written notice of One day to the Corporate purchaser of the cards. The replacement Card will be issued subject to the tenure of the Card being still live and money being available on the Card. YOLO and YES BANK reserve the right to cancel and terminate the card at any time without any notice to the cardholder if there is reason to suspect any unusual, illegal, unlawful or money laundering activity. A replacement card in this situation will be issued at the sole discretion of YOLO and YES BANK. Upon the expiry of the Card, the remaining unused amounts shall be forfeited in favour of YOLO Cards. YOLO and YES BANK will provide prior notice of 30 days before the expiry of the Card by way of e-mail on the cardholder’s registered e-mail address on YOLO’s records. It is the sole responsibility of the cardholder to ensure that the contact information maintained with YOLO and YES BANK is kept up to date.
  6. Termination :
    • The Cardholder may block his/her access to the Application and/or discontinue availing the Services, by using the ‘Suspend’ option on the Application. The Cardholder shall remain responsible for any transactions made through the Application until the time of such termination.
    • YOLO and YES BANK may withdraw or terminate the access to the Application and/or discontinue provision of the Service/s anytime either entirely or with reference to a specific Service or Cardholder; or in case of breach of the Terms by the Cardholder without prior notice; or if it learns of the death, bankruptcy or lack of legal capacity of the Cardholder.
  7. Loss/theft/misuse of cards :
    • If a Card is lost or stolen, the Cardholder must immediately suspend the card on the YOLO Cards application (accessible 24 hours a day, 7 days a week, 365 days a year) and acknowledge that he/she/it will not be able to use the card for any transaction after disabling the card. He/She/It must also report such loss/theft to YOLO Cards on YOLO’s Customer Care number - 9017-950-960 as well as intimate the loss/theft/misuse of the card at yoloassist@yolo.cards
    • The Cardholder's right to use the Card shall be terminated by the cardholder through the ‘Suspension’ option on the Application forthwith in the event of Loss or theft of the Card discovered by the Cardholder.
    • The Cardholder shall accept full responsibility for any wrongful or fraudulent use of the Card and which is or may be in contravention of these Terms and Conditions.
  8. Disclosure :
    • Type of information relating to card holder to be disclosed with and without approval of card holder
    • i. The Cardholder acknowledges that the information on usage of the Card could be exchanged amongst banks and financial entities that provide similar facilities.
    • ii. YOLO and YES BANK are not obliged to disclose to the Cardholder the name of the bank or financial entity to which it disclosed the information.
    • iii. The Cardholder shall, prior to availing the Card Services from YOLO and YES BANK, obtain appropriate advice and shall familiarize himself with the associated risks and all the terms and conditions pertaining to the service.
    • iv. The Cardholder shall be bound by these Terms & Conditions and / or any other policy (ies) that may be stipulated by YOLO Cards or YES BANK, from time to time, in this regard.
    • v. The Card can be used only in India after activation and cannot, under any circumstances, be exchanged for cash.
    • vi. The Card is not transferable under any circumstances.
    • vii. The Card is Reloadable in nature in accordance with the policies in force and amended from time to time by regulatory authorities
    • viii. The Card can be used at ATM's for cash withdrawals subject to completion of prevailing compliance requirements, if any, and as amended from time to time. YOLO Cards and YES BANK shall not be held liable for any such transactions under any circumstances whatsoever. In case the Cardholder uses or attempts to use the card at an ATM the applicable charges will be debited from the Card.
    • ix. Any request for Card replacement by the Cardholder will be processed by YOLO Cards and the Card will only be sent to the Registered Delivery address as updated by the cardholder on YOLO and YES BANK’s records. The cardholder acknowledges that the Card Replacement Fee needs to be paid to YOLO prior to processing of the request for the replacement card. In case of insufficient funds in the Card, YOLO and YES BANK will not be liable to entertain such requests for Card replacement.
    • x. The Cardholder shall indemnify YOLO & YES BANK to make good any loss, damage, interest, or any other financial charge that Yes Bank/YOLO may incur and/or suffer, whether directly or indirectly, as a result of the Cardholder committing violations of these Terms and Conditions.
    • xi. Cardholder and Corporate purchasers agree that issuing of the Card is subject to rules and regulations introduced or amended from time to time by the Reserve Bank of India or any other regulatory body.
  9. Applicability of Terms :
    • These terms and conditions form the contract between the Cardholder and YOLO/YES BANK for availing Services through this Application. For availing the Services, the Cardholder shall be first be required to register on the Application. YOLO and Yes Bank shall be entitled at their sole discretion to accept or reject such registration requests by the Cardholder/s and its decision in this regard shall be final and binding. By registering for the Application for availing the Services, the Cardholder acknowledges and accepts these Terms and Conditions
    • While availing the Services through the Application, certain additional service terms and conditions or notes (“Service Terms”) applicable, if any, with respect to the specified services, shall be communicated to the Cardholder through notes, additional notes or additional terms & conditions while availing the Services and the Cardholder’s conduct of continuing to avail the Service shall amount to his/her acceptance of such Service Terms and shall be binding on the Cardholder.
  10. APPLICATION :
    • For the purpose of availing the Services through the Application, the Cardholder shall register herself/himself through the Application itself. The information provided to the Cardholder through the Application is not updated continuously but at regular intervals. Consequently, any information supplied through the Application will pertain to the date and time when it was last updated and not on the date and time when it is supplied to the Cardholder. YOLO and YES BANK shall not be liable for any loss that the Cardholder may suffer by relying on or acting on such information. YOLO and YES BANK may keep records of the transactions in any form they wish. In the event of any dispute YOLO and YES BANK’s records shall be binding as the conclusive evidence of transactions carried out through the Application in the absence of clear proof that YOLO and YES BANK’s records are erroneous or incomplete.
    • Any request for any service which is offered as a part of the Application shall be binding on the Cardholder as and when YOLO and YES BANK receive such a request. If any request for a Service is such that it cannot be given effect to unless it is followed up by requisite documentation on the part of the cardholder, YOLO and YES BANK shall not be required to act on the request until they receive such documentation from the Cardholder. The Cardholder shall ensure that the Application is not used for any purpose which is illegal, improper or which is not authorized under these Terms/other specified terms.
  11. Registration :
    • To avail services through the Application, the Cardholder has to first register, the process for which shall be followed by the Cardholder on the Application itself. Any person who is 10 years of Age or more is eligible to register
    • A cardholder can log in to the Application with his/her Registered Email Id/Password created at the time of registration. The Cardholder shall be provided an access to the following on a successful log-in:
      • Wallet issued at the time of registration
      • Virtual Card Account(s)
      • Host of Services offered through the Application
    • A Cardholder can register by providing his/her profile details like Name, address, e-mail id mobile number etc. and authenticating himself/herself through his e-mail address. A wallet is created instantly and the Cardholder has the choice to create his first Virtual 16 digit MasterCard Card. An OTP (One Time Password) is sent to the mobile number provided by him/her during the registration process. Once e-mail and mobile verification are successful the Cardholder is allowed to top-up his card using standard banking channels, apply for a physical card and load/unload funds from/to his wallet, virtual card and physical card.
  12. Log in to Application :
    • A cardholder can log in to the Application with his Registered E-mail Id/Password created at the time of registration. The cardholder shall be provided access to the following on successful log-in
      • Wallet
      • Virtual Card
      • Physical Card
      • Host of Services offered through the Application
  13. Services :
    • Following are the products and services which shall be offered through the Application. YOLO and YES BANK reserve the right to remove any of the products or services being offered or introduce any new product or services without intimation to the Cardholder.
    • View only Requests:
      • Wallet Balance Inquiry/Virtual Card Balance Inquiry/Physical Card Balance Inquiry
      • Detailed account history of the wallet, virtual card(s), physical card(s)
      • Virtual Card Number, Valid Thru date, CVV number
    • Self Service Requests:
      • Top-up Card and load to Wallet
      • Load from wallet to Virtual Card(s)
      • Unload from Virtual Card(s) to wallet
      • Load from wallet to Physical Card(s)
      • Unload from Physical Card(s) to wallet
      • Suspending a Card
      • Communication Address update
      • Change of registered email id and verification of registered email id of Cardholder
      • Change of registered mobile number and verification of registered mobile number of Cardholder
      • Change of password
      • Activating a Physical Card
      • Apply and pay for the Physical Card
        • YOLO Yes Bank Instant MasterCard
        • YOLO Yes Bank Classic MasterCard
        • YOLO Yes Bank Customized MasterCard
    • Financial Services
      • Payment through Wallet for payment of utility services like pre-paid, post-paid mobile bills, Landline, Gas, Electricity, Water Bills
      • Payment from the Physical Card for any online or off-line transaction in India at any establishment that accepts MasterCard
      • Payment from the Virtual Card for any online transaction in India at any establishment that accepts MasterCard
      • Sending funds to and receiving funds from YOLO Cardholders as well as through e-mail and mobile number
      • Payment options from the “Offers’ option on the Application
      • The availability/non-availability of a particular Service shall be communicated to the Cardholder through email or web page of YOLO or in writing as may be deemed fit by YOLO and YES BANK. Services through this Application may be provided by YOLO and YES BANK directly or through its associates or contracted service providers on behalf of YOLO and YES BANK.
      • Further the Application provides the Cardholder with the facility to get a Customized Physical Card. The Cardholder shall ensure that the use of such facilities shall not defame or malign the image of YOLO and YES BANK, by using inappropriate words and images while availing the facilities. The images used, if any, should adhere to the Image Submission Policy and guidelines which are attached as an annexure “A” to these Terms & Conditions.
  14. Limitation on Transactions :
    • YOLO and YES BANK at their sole discretion may introduce new limit/s, modify the said limit/s or detach/attach limits on transactions at any point of time.
  15. Unauthorised Access :
    • The Cardholder shall take all necessary precautions to prevent unauthorized and illegal use of the Application and Services offered through the Application. The Cardholder agrees not to use/access the Application and/or Services offered through the same in any manner other than as authorized by YOLO and YES BANK. Where the Cardholder uses the Application for any purpose which is illegal, improper or which is not authorised under these Terms/ Service Terms, YOLO and YES BANK shall have a right to disable the use of the Application. YOLO and YES BANK shall take all commercially reasonable care to ensure the security of and to prevent unauthorised access to the Application and the Services offered through this Application using commercially reasonable technology available in India.
  16. Charges :
    • Charges are informed upfront to the Cardholder before committing the transaction. YOLO and YES BANK reserve the right to charge or modify existing charges by giving due notice which shall not be less than 24 hours and recover from the Cardholder such charges for providing Services through the Application. The Cardholder hereby authorises YOLO and YES BANK to recover the said charges by debiting his wallet or his Virtual or his Physical Card or by sending a bill to the Cardholder who shall be liable to make the payment within the specified period. Failure to do so shall result in recovery of the applicable charges by YOLO and YES BANK in a manner as YOLO and YES BANK may deem fit along with interest, if any, and/or suspension of the Services made available through the Application without any liability to YOLO and YES BANK.
  17. Documents :
    • The Cardholder expressly agrees and acknowledges that in the event the Cardholder chooses to apply for Service/s provided by YOLO and YES BANK through Application, he/she may do so, by submitting the required documents online in the manner specified by YOLO and YES BANK unless specifically required by YOLO and YES BANK to be submitted in physical form only / also. In the event such facility is sanctioned by YOLO and YES BANK to the Cardholder, the Cardholder expressly agrees and acknowledges to have read and understood the terms and conditions that govern the Services being offered through the Application and be bound by such terms and conditions at all times and which may be amended by YOLO and YES BANK from time to time. Further, the Cardholder agrees and undertakes to sign such other documents as may be required by YOLO and YES BANK from time to time.
  18. Authority to YOLO and YES BANK :
    • The Cardholder irrevocably and unconditionally authorises YOLO and YES BANK to access his Wallet or Virtual Card or Physical Card for effecting payment or other transactions performed by the Cardholder through the Application.
    • By linking his/her social networking accounts of Facebook, Twitter or Google+ or Instagram or any other Social Networking Website to this Application the Cardholder understands and acknowledges that YOLO and YES BANK shall have access to and retain the information of the Cardholder’s social networking accounts including but not limited to basic information such as e-mail ID, profile information, photographs and list of friends, followers and followings.
    • The Cardholder understands and acknowledges that social networking sites are not seeking any Account related information/details of the Cardholder and shall not be liable in any manner for such information/details.
    • YOLO and YES BANK shall have no obligation to verify the authenticity of any transaction/ instruction received or purported to have been received from the Cardholder through the Application or purporting to have been sent by the Cardholder other than by means of authenticating through Registered Email Id/Password.
    • The read-out, the faxed /email output or the printed output, if any, that is received by the Cardholder at the time of availing the Service/s shall be deemed to be a proof of the availment of the Services on the Application through operation of a computer or any other medium enabled by YOLO and YES BANK for this purpose, by the Cardholder and shall be accepted as conclusive and binding for all purpose. All records of the transactions, generated by YOLO and YES BANK and arising out of the availment and use of the Service/s through the Application, including the time the transaction recorded shall be conclusive proof of the genuineness and accuracy of the transaction. While YOLO and YES BANK shall endeavour to carry out the instructions promptly, they shall not be responsible for any delay in carrying on the instructions due to any reason whatsoever, including due to failure of operational systems, technical issues or any requirement of law.
  19. Accuracy of Information :
    • The Cardholder is responsible for correctness of the information supplied to YOLO and YES BANK for access / use of the Application and/or availment of Services through any other means such as electronic mail or written communication. YOLO and YES BANK accept no liability for the consequences arising out of erroneous information supplied by the Cardholder. If the Cardholder notices an error in the information supplied to YOLO and YES BANK either in the application form or any other communication, he shall immediately inform YOLO and YES BANK of such error. YOLO and YES BANK will endeavour to correct the error wherever possible on a "reasonable efforts" basis.
    • A Cardholder must ensure that correct information is provided at the time of registration regarding name, address, DOB, mobile, email id etc. Where YOLO and YES BANK find the information so provided prime facie to be incorrect or fictitious, then they shall have the right to terminate the usage of the Application and effect closure of the wallet with forfeiture of the amount if any, lying in the wallet.
  20. Liability of the Cardholder and YOLO and YES BANK :
    • Neither YOLO and YES BANK nor its Affiliates shall be liable for any unauthorised transactions occurring through the access / use of the Application and/or availment of Services and the Cardholder hereby fully indemnifies and holds YOLO and YES BANK and Affiliates harmless against any action, suit, proceeding initiated against it or any loss, cost or damage incurred by it as a result thereof. YOLO and YES BANK shall under no circumstance be held liable to the Cardholder if the access to the Application and/or Services is not made available in the desired manner for reasons including but not limited to natural calamities, legal restraints, faults in the telecommunication network or network failure or any other reason beyond the control of YOLO and YES BANK. Under no circumstances shall YOLO and YES BANK be liable for any damages whatsoever whether such damages are direct, indirect, incidental consequential and irrespective of whether any claim is based on loss of revenue, interruption of business or any loss of any character or nature whatsoever and whether sustained by the Cardholder or by any other person.
    • Illegal or improper use of the Application and/or Services shall render the Cardholder liable for payment of financial charges as decided by YOLO and YES BANK and/or will result in suspension of the operations through the Application.
  21. Disclaimer of Warranties :
    • The Cardholder expressly agrees that the access / use of the Application and/or availment of Services is at the Cardholder’s sole risk. The Application is provided on an "as is" and "as available" basis.
    • Except as warranted in the Terms, YOLO and YES BANK expressly disclaim all warranties of any kind, whether express or implied or statutory and including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, data accuracy, completeness and any warranties relating to the non-intrusion by hackers into the Application / Services.
    • YOLO and YES BANK do not warrant that access to the Website and Application and/or Services shall be uninterrupted, timely, secure, or error free nor does it make any warranty as to the results that may be obtained from the use of the Website/ Application, accuracy or reliability of the Application and/or Services. YOLO and YES BANK do not warrant and shall not be responsible for any delay in carrying on the instructions due to any reason whatsoever, including due to failure of operational systems, technical issues or due to any requirement of law.
    • YOLO and YES BANK will not be liable for any malware/ virus that may enter the Cardholder's system as a result of the Cardholder using/accessing the Application and/or during availment of the Services. YOLO and YES BANK does not guarantee to the Cardholder or any other third party that the Application would be virus/ malware free.
  22. Indemnity :
    • The Cardholder agrees, at its own expense, to indemnify, defend and hold harmless YOLO and YES BANK, its directors and employees, representatives, agents, and its Affiliates against any claim, suit, action or other proceeding brought against YOLO and YES BANK, its directors and employees, representatives, agents and Affiliates by a third party to the extent that such claim, suit, action of other proceeding brought against YOLO and YES BANK, its directors and employees, representatives, agents, and Affiliates is based on or arises in connection with:
    • i. a violation of the Terms and Conditions contained herein by the Cardholder; ii. any deletions, additions, insertions or alterations to, or any unauthorized use of / access to Application /Service(s), by the Cardholder; iii. any misrepresentation or breach of representation or warranty made by the Cardholder contained herein; or iv. any breach of any covenant or obligation to be performed by the Cardholder hereunder.
    • The Cardholder agrees to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys' fees and costs awarded against it or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.
    • The Cardholder hereby agrees that under no circumstances, YOLO and YES BANK's total aggregate liability for claims relating to YOLO and YES BANK’s obligations contemplated under these Terms and Conditions, whether for breach or in tort (including but not limited to negligence) shall exceed the transaction charges/fees or consideration paid by the Cardholder within the previous twelve (12) months for use of / access to Application / availing Service(s), excluding any amount paid towards transactions.
  23. Disclosure of Information :
    • The Cardholder agrees that YOLO and YES BANK and/or Affiliates or their contractors may hold and process his Personal Information and all other information concerning his Account(s) on computer or otherwise in connection with the use of / access to Application / availing Service(s) as well as for analysis, credit scoring and marketing. The Cardholder also agrees that YOLO and YES BANK may disclose, in strict confidence, to other institutions, such Personal Information as may be reasonably necessary for reasons inclusive of but not limited to participation in any telecommunication or electronic clearing network, in compliance with a legal directive, for credit rating by recognised credit scoring agencies, or for fraud prevention purposes.
    • As per the Information Technology Act, 2000 (“Act”) a subscriber may authenticate an electronic record by affixing his digital signature. The Act also provides legal recognition to digital signatures for authentication of electronic records.
    • However, YOLO and YES BANK have adopted the mode of authentication of the Cardholder by means of verification of the Registered Email Id/password which are not recognized under the Information Technology Act, 2000 for authentication of electronic records. Therefore, the Cardholder is solely responsible for maintaining the secrecy and confidentiality of the Password / PIN / Card details without any liability of YOLO and YES BANK in this regard.
  24. Change of Terms
    • YOLO and YES BANK shall have the absolute discretion to amend or supplement any of the Terms and Conditions at any time and shall give a notice of amendment or supplement or other change whatsoever by hosting the same on the Website or in any other manner as decided by YOLO and YES BANK. The Cardholder shall be responsible for regularly reviewing these Terms and Conditions including amendments thereto as may be posted on the Website. Such amended Terms and Conditions will thereupon apply to and be binding on the Cardholder immediately on such amendment or supplement being made to any Terms and Conditions.
    • If in the opinion of the Cardholder, the changes are to his/her disadvantage, the Cardholder may opt to close the Account and/or discontinue with the Service/s, at any time up to one month from the date of the notice by intimating YOLO and YES BANK of the same. However, the Cardholder shall be liable to pay any extra charges that maybe applicable owing to such amendment or supplement being made to any Terms and Conditions for the period starting from the implementation of the said amendment till the date of the communication by the Cardholder of his intention to discontinue with the Service/s.
    • By using any new Services as may be introduced by YOLO and YES BANK, the Cardholder shall be deemed to have accepted the modified Terms as stipulated by YOLO and YES BANK.
  25. Non-Transferability :
    • The grant of access to the Application to a Cardholder is not transferable under any circumstance.
  26. Notices :
    • Notices under these Terms may be given by YOLO and YES BANK and the Cardholder in writing by delivering them by hand or by sending them by post to the last address given by the Cardholder and in the case of YOLO and YES BANK to its corporate office addresses as set out hereinabove. In addition, YOLO and YES BANK may also publish notices of general nature, which are applicable to all Cardholders in newspapers and/or on their Website. Such notices will have the same effect as a notice served individually to each Cardholder. Notice and instructions will be deemed served 7 days after posting or upon receipt in the case of hand delivery, cable, telex or facsimile.
  27. Governing Law :
    • These Terms and/or the operations in the Account of the Cardholder shall be governed by the laws of India. The Cardholder agrees and confirms that all claims, matters and disputes are subject to the jurisdiction of the competent courts in Mumbai and irrevocably submit themselves to the jurisdiction of that court or tribunal. These Terms shall be governed by the laws of the Republic of India. The Parties hereby agree that any legal action or proceedings arising out of the Terms shall be brought in the courts or tribunals at Mumbai in India and irrevocably submit themselves to the jurisdiction of such courts and tribunals.
    • YOLO and YES BANK may, however, in its absolute discretion, commence any legal action or proceedings arising out of the Terms in any other court, tribunal or other appropriate forum, and the Cardholder hereby consents to this right of YOLO and YES BANK. Any provision of the Terms which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of prohibition or unenforceability but this shall not invalidate the remaining provisions of the Terms in such jurisdiction or affect such provision in any other jurisdiction.
    • The Cardholder hereby agrees to abide by the Terms on Signing up on the YOLO and YES BANK Mobile or desktop Application or by signing up through the YOLO web-site and the Cardholder shall be deemed to have unconditionally agreed to and accepted the Terms by performing a transaction with the Card.   28. Applicability to Future Accounts :
    • YOLO/ YES BANK and the Cardholder agree that if the Cardholder opens further Accounts with/subscribes to any of the products/services of YOLO and YES BANK or any of the Affiliates and YOLO and YES BANK extend the access to the Application/ Services to such Accounts or products or services and the Cardholder opts for the use thereof then the Terms and Conditions shall automatically apply to such further use / access by the Cardholder.
  29. General :
    • The clause headings herein are only for convenience and do not affect/be deemed to affect the meaning of the relative clause. YOLO and YES BANK may sub-contract and employ agents to carry out any of its obligations under this contract. The Cardholder would have to ensure that the equipment used for availing of the Services / accessing the Application meets the criteria as may be specified by YOLO and YES BANK from time to time. All costs incurred by the Cardholder including telecommunication costs to access the Application / avail the Service/s shall be borne by the Cardholder.
    • As a tool to correct misunderstandings, the Cardholder understands, agrees and authorises YOLO and YES BANK, at its discretion, and without further prior notice to the Cardholder, to monitor and record any or all telephone conversations or electronic communications between the Cardholder and YOLO and YES BANK and any of YOLO and YES BANK’s employees or agents.
    • These Terms contain YOLO and YES BANK's entire arrangement (except as otherwise expressly provided herein) and supersede and replace any previously made proposals, representations, understandings and agreements, express or implied, either oral or in writing between the Cardholder and YOLO/YES BANK for arrangement contemplated under these Terms. The Cardholder acknowledges that it has not relied on any representation made by YOLO and YES BANK or any of its employees or agents and has made its own independent assessment for availing Service/s and/or accessing Application. No third party will have any rights or claims under these Terms.
  30. Proprietary Rights :
    • YOLO and YES BANK shall make reasonable efforts to advise the Cardholder/s from time to time regarding the webbrowsers or mobile softwares required for availing the Service(s) and/or accessing the Application. There will be no obligation on YOLO and YES BANK to support all or any versions of the web-browser/s or mobile software as may be required for offering Service(s)/ providing access to Application the webbrowser/s or mobile softwares have not been advised by YOLO and YES BANK. The Cardholder acknowledges that the underlying software as well as web-browsers or mobile softwares required for accessing the Application / availing the Service/s are the legal property of the respective vendors. The permission given by YOLO and YES BANK to access the Application / avail the Service/s will not convey any proprietary or ownership rights in such software. The Cardholder shall not attempt to modify, translate, disassemble, decompile or reverse engineer the underlying software or create any derivative product based on the software. “YOLO” and “YES BANK” logo are trademarks and property of YOLO and YES BANK Limited respectively. Infringement of any intellectual property is strictly prohibited.
  31. Communications through Electronic means :
    • Documents sent by electronic delivery will contain all the information as it appears in the printed hard copy version as prepared and distributed by the originator, with the possible exception of graphic insertions such as photographs or logotypes. Electronic delivery may be in the form of an electronic mail, an attachment to the electronic mail or in the form of a downloadable file on the Website or the Application. YOLO and YES BANK would be deemed to have fulfilled their legal obligation to deliver to the Cardholder any document if such document is sent via electronic means. Failure to advise YOLO and YES BANK of any difficulty in opening a document so delivered within twenty-four (24) hours after delivery shall serve as an affirmation regarding the acceptance of the document.

"The products and services referred to herein are subject to the terms and conditions governing them as specified by YOLO and YES BANK from time to time at the website of YOLO i.e. www.yolo.cards . Nothing contained herein shall constitute or be deemed to constitute an advice, invitation or solicitation to purchase any products/ services of YOLO and YES BANK. "YOLO" and "YES BANK" logos are trademark and property of YOLO and YES BANK Ltd respectively. Misuse of any intellectual property, or any other content displayed herein is strictly prohibited. Our relationship is governed exclusively by these terms & conditions and no presumption of any relation other than that contemplated by this document shall be presumed or exist. YOLO and YES BANK are not acting in a fiduciary capacity when making available any of the products and services referred to in this document, and accept no liability nor responsibility whatsoever with respect to the use of this document or its contents. YOLO and YES BANK may, at their sole discretion, utilize the services of external service provider/s or agent/s and on such terms as required or necessary, in relation to its products/services."

IMAGE SUBMISSION POLICY :
  1. The Cardholder represents and warrants that a valid license for all the Intellectual Property contained in the Image vests with the Cardholder.
  2. To the extent that YOLO and YES BANK provide the Cardholder the services and/or facilities through the Application, the Cardholder agrees and hereby grants, and further, represents and warrants that the Cardholder has the adequate right and power to grant YOLO and YES BANK, and the Partner Institution/s, an irrevocable, non-transferable, royalty-free, worldwide right to use, modify, print/emboss, store and reproduce the Image.
  3. YOLO and YES BANK understand that the Intellectual Property in the Image vests in the Cardholder and YOLO and YES BANK claim no right, interest, title over the Image. The Cardholder continues to retain the ownership/license in all Intellectual Property Rights in the Image. The Cardholder may on his/her own free will, send their Customized Card Image, as created on the yolo website, without any Card number and expiration date details, from his/her registered e-mail address, if they wish to have YOLO evaluate posting of such image on the website for the purpose of posting testimonials or to enter promotional contests. Such images will only be accepted if they are devoid of card number information and valid thru date.
  4. The Cardholder further represents that the use of the Image by YOLO and YES BANK and/or the Partner Institution/s in accordance with the Terms and Conditions and does not violate the Intellectual Property Rights of third parties, and any applicable laws or regulations in force.
  5. The Cardholder is solely responsible for the use of the Image. YOLO and YES BANK are providing this service at the request of the Cardholder, and shall not be liable for any claims relating to the Image or its use therein.
  6. The Cardholder agrees that any dispute between the Cardholder and any third party with regard to the Images submitted by the Cardholder shall be resolved between the Cardholder and the third party without any reference whatsoever to YOLO and YES BANK in relation to such a dispute. YOLO and YES BANK shall not be liable for any loss/damage/harm suffered by either the Cardholder or any third party in this regard.
  7. The Images are required to adhere to the Image Checking Guidelines, as uploaded on YOLO’s Website www.yolo.cards
  8. The Image uploaded by the Cardholder should be free of any spyware, malware, virus or any other content which is harmful to YOLO and YES BANK or its Partner Institution/s.
IMAGE GUIDELINES :

Images containing any of the following elements would not be allowed –

  1. Trademarks or copyright material that is famous or recognised, including Images carrying ©, ® or ™ signs, images that have advertising, promotional material including images of products of specific brands and all Images that have telephone numbers, URLs, account numbers or email addresses
  2. Images of celebrities/musicians/athletes/entertainers/public-figures/cartoon characters etc. who are widely recognised.
  3. Provocative or sexual Images including those containing nudity, offensive and/or racist images including any images in which weapons or fire arms have been displayed.
  4. Images portraying or promoting or likely to incite communal, anti-social or obscene behaviour.
  5. Images wherein intoxication, smoking, narcotics and/or gambling or activities of similar nature have been displayed.
  6. Any religious or political Images, including Images that portray groups banned by law/ views of which are likely to cause social unrest or political or religious statements and/or text or illustrations.
  7. Images containing subject matter of any nature that might result confusion regarding the Application or that might result in transaction fraud through the application.
  8. Any Image that might reflect poorly or might engender hostility towards YOLO or YES BANK or Master Card ® or any other payment network brands.
  9. Images where money or currency is in focus.
  10. Any reference to trade names, logos, slogans or any other reference identifying any Card Processing Associations (e.g. Visa, Master Card, American Express, etc.) and any references to brands associated on a sponsorship basis with any such Card Processing Associations
  11. Images that portray profanity or obscene images which portray YOLO and YES BANK logo in bad light.
  12. Images which show the names or Images of any other Banking or Financial Institution.
  13. Images that have any emblems, flags, or logos pertaining to the Constitution of India or any other government body.
